By using our Services, you agree to these Terms of Service ("Terms"). If you do not agree, do not use our Services.

2. Services Provided

creatyl LLC provides an online platform that allows users to sell digital products, courses, memberships, coaching, and other offerings.

3. User Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account.
• We reserve the right to suspend or terminate accounts that violate our Terms.

4. Payment and Fees

• Users selling on our platform may be subject to transaction fees.
• Payments are processed through third-party provider like Stripe.
• Subscription fees, if applicable, must be paid on time to maintain access to Services.

5. Refunds

Refund policies are determined by each seller. creatyl LLC does not issue refunds for digital products unless required by law.

6. Prohibited Activities

You may not:

• Use our Services for illegal purposes.
• Infringe on intellectual property rights.

These Terms are governed by the laws of Utah, USA. Any disputes must be resolved in the courts of Utah.

12. Changes to These Terms

We may update these Terms at any time. Continued use of the Services means you accept any revisions.

13. End of Access

Upon cancellation of a paid subscription, the subscriber (referred to herein as the "Creator") will retain access to all paid features and content until the end of their current billing period. After this period, all premium functionality will be disabled, and the account will enter a restricted "read-only" state.

14. Effect on End Customers

Creators acknowledge and agree that access to any digital products, courses, or other content sold to their customers via the creatyl platform is contingent upon the Creator's active subscription status. Once a subscription is canceled and the billing period ends, all customer access to such content will be terminated. creatyl is not responsible for refunding, compensating, or managing disputes between the Creator and their customers following cancellation.

Creators are solely responsible for informing their customers in advance of any planned termination of access or changes in service availability due to cancellation.

15. Data Retention and Account Reactivation

Following subscription cancellation, creatyl will retain the Creator's account data, including content, customer lists, and transaction history, in a read-only format for a period of six (6) calendar months. During this period, Creators may:

• Reactivate their account to restore full access;
• Download or export their stored content and customer data.

After this six-month retention period, all associated data will be permanently deleted and will not be recoverable. creatyl may, but is not required to, provide a final notice to the Creator prior to deletion.

16. Immediate Account Deletion

Creators may request immediate permanent deletion of their account and all associated data at any time. This action is irreversible. By proceeding with such a request, the Creator waives any right to access or retrieve deleted content or data.

17. Subscription Management

All subscription cancellations must be completed by the Creator via the platform's self-service interface. Cancellations take effect at the end of the current billing cycle, and no prorated refunds will be issued for unused time unless otherwise required by law.

18. Communication and Timing

Upon cancellation, creatyl will provide the following:

• A confirmation email at the time of cancellation, which will include the effective end date of premium access and information about data retention.
• A reminder email may be sent prior to the end of the billing cycle, where feasible.
• A follow-up email may be sent during the data retention window to provide a reactivation option.

If the cancellation is submitted close to the renewal date (e.g., same-day or next-day renewal), creatyl is not obligated to send multiple advance notices but will send the standard cancellation confirmation.

19. Customer Responsibility

The Creator is solely responsible for:

• Delivering or fulfilling their content obligations to end customers;
• Communicating any termination of access to their customers;
• Handling any related support, refund requests, or legal obligations.

creatyl is not a party to any transaction between Creators and their customers and disclaims any responsibility related to content access following Creator cancellation.
